The federal government has withdrawn the forgery charge filed against constitutional lawyer Mike Ozekhome before a high court in the federal capital territory.
The charge was initially filed by the Independent Corrupt Practices and Other Related Offences Commission (ICPC) following a judgment of a London court concerning a property owned by the late General Jeremiah Useni, a former FCT Minister.
The office of the attorney-general of the Federation had earlier taken over the prosecution of the case.
However, Rotimi Oyedepo the director of public prosecutions of the federation informed Justice Peter Kekemeke on Tuesday that the case file was being withdrawn.
Oyedepo said the action was taken in line with Section 108 of the Administration of Criminal Justice Act and explained that the withdrawal was for “further instruction.”
Counsel to Ozekhome, Paul Erokoro (SAN), told the court that the defence had no objection to the application.
In his ruling, Justice Kekemeke granted the request.
The judge held that since the application was not opposed, the charge was withdrawn and accordingly dismissed.
